What should I bear in mind when buying a property in the Balearic Islands in 2023? The property market is constantly changing, as buyers are affected by different factors such as the interest rates offered by the banks or the variation in the percentage of the Transfer Tax, - which, in 2023 in the Balearic Islands and with the publication of the BOIB 171 of 31 December 2022, has had a 4% reduction for the purchase of a first habitual residence whose value is less than 270,000 € -.    As of today, 26th January 2023, we still have no clear news on how mortgages will be this year - with no clue as to when the Armengol government's famous guarantee for 100% financing will be implemented. But with the information we do have we bring you an example that clearly, as Shakira would say, anticipates the purchase scenarios, taking into account the complexity of these, as not only the value of the property must be taken into account, but also the guarantee, the characteristics of the mortgagors, etc.    Example of home purchase in the Balearic Islands in 2023    Taxes 6.800€. Notary fees 1.100€. Registration 540€. Management fees (Gestoría)  390,8€ Shipping fees 30€ 1st insurance instalment 478,45€. Difference not financed by the bank  1.692€ TOTAL 11.031,25€. As we can see in the example above, this is a purchase and sale of a property worth 170,000. Of this 170.000€, 10% (17.000€) has already been paid as a deposit.  As a result, the buyer will have to pay the remaining 90% on the day of signing, which is 153.000€ (in this case the bank only finances 89%, i.e. 151.308€, so the remaining 1.692€ will have to be paid by the buyer out of pocket).  In this case, and following the new TAX reduction, the person will have to pay 4% -as long as this is their first habitual residence- of the 170.000€ that the property is worth, that is to say, around 6.800€.    How do I know if I have to pay 4% or 8% on the purchase of a property? According to the BOIB 171 of 31 December 2022, fourth final provision: Modification of the Legislative Decree 1/2014, of 6 June, which approves the revised text of the legal provisions of the autonomous community of the Balearic Islands on taxes ceded by the State:   "[...] when the real or declared value - provided that the latter is higher than the real value - of the property is equal to or less than 270,151.20 euros, and provided that the property is to constitute, at the time of purchase, the purchaser's habitual residence, under the terms established by the regulations governing personal income tax, and the purchaser does not have any other right of ownership or use or enjoyment in respect of any other property, the applicable tax rate is 4%." Meaning that the person will pay 4% of the value of the property if: The price of the property is equal to or less than 270,151.20 euros. The property is the habitual residence of the buyer. The buyer does not have any other right of ownership or right of use or enjoyment in respect of any other property - e.g. the buyer is in the process of accepting an inheritance or has another property in his or her name. In case one of the above-mentioned requirements is not fulfilled, the person will have to pay an ITP of 8% of the declared value of the property. Do you still have doubts about mortgage processing?
